CAN SPAM Act

The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.

COPPA (Children Online Privacy Protection Act)

When it comes to the collection of personal information from children under the age of 13 years old, the Children’s Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, United States’ consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children’s privacy and safety online. We do not specifically market to children under the age of 13 years old.

Privacy Notice for California Residents

Collection of Personal Information. The categories of personal information we have collected in the twelve (12) months prior to the Effective Date and that we may collect include:

A) Identifiers such as a real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, a device identifier; an Internet Protocol address; cookies, beacons, pixel tags, mobile ad identifiers or similar technology; customer number, unique pseudonym or user alias; telephone numbers, or other forms of persistent or probabilistic identifiers that can be used to identify a particular consumer or device;

B) Signature, physical characteristics or description, telephone number, state identification card number, insurance policy number, employment, employment history, bank account number, credit card number, debit card number or any other financial information, medical information or health insurance information;

C) Internet or other electronic network activity information, including, but not limited to, browsing history, search history and information regarding a consumer’s interaction with an internet website, app or advertisement.

  1. Disclosure of Personal Information. We have disclosed the categories of personal information listed in clause 1 above for a business purpose in the twelve (12) months prior to the Effective Date and may disclose such personal information to service providers who support our business provided they do not sell such personal information or retain, use or disclose such information for any purpose other than for the specific purpose of performing the services specified in our contract with them. We do not sell (as the term is defined in the CCPA) the personal information. We collect, including personal information of minors under sixteen (16) years of age, and will not sell it without providing a right to opt out. We have not sold (as the term is defined in the CCPA) any personal information in the twelve (12) months prior to the Effective Date.
  2. Your Rights. You have certain rights, subject to certain limitations under applicable law, with respect to your personal information, including:

a) The right to request disclosure of details of personal information collected.

b) The right to request disclosure of information sold (as defined in the CCPA).

c) The right to deletion of your personal information.

d) The right to “opt out” of any sale (as defined in the CCPA), if such sale occurs.

e) The right not to be discriminated against for exercising your rights under CCPA. We will verify your request using the information associated with your account, including e-mail address and/or Government identification. We will let you know if we need additional information to verify your identity. Consumers may also designate an authorised agent to exercise these rights on their behalf.

  • Where we are a service provider. We may also act as a service provider (as the term is defined in the CCPA). When we act as a service provider, including by providing our services to another company that you interact with, we follow the instructions of the company that engaged us as a service provider and you should directly contact that company if you have any questions or would like more details on how your personal information is processed by that company.

Children

Our Services are not directed to persons under 18, and we do not knowingly collect personal information from children under 18. Any individuals under the age of 18 must have consent from their parent or guardian to use the Services. If a parent or guardian becomes aware that his or her child has provided us with personal information without their consent, he or she should contact us at support@growthmonkey.ai. If we become aware that a child under 18 has provided us with personal information, we will take steps to delete such information from our files.

Special Notice for Individuals in the EEA, UK, and Switzerland

This section only applies to interactions with individuals who are citizens of, or at the time of data collection reside in, the EEA, UK, or Switzerland (collectively, the “Designated Countries”).

  1. Role. Growth Monkey is a data controller with respect to any personal information collected from users of the Services. Any third parties that handle your personal information in accordance with our instructions are our service providers and are “data processors.” You are a “user.” Users are individuals providing personal information to us via the Services pursuant to a contract that has been entered into with Growth Monkey.

We may limit these privacy rights requests (a) where denial of access is required or authorized by law, (b) when granting access would have a negative impact on others’ privacy, (c) to protect our rights and properties, or (d) where the request is frivolous or burdensome. We may seek to verify your identity when we receive your privacy rights request to ensure the security of your personal information.

We may continue to process your personal information if it is necessary for the defense of legal claims, or for any other exceptions permitted by applicable law.
    • Notification to third parties. When we fulfill your individual rights requests for correction, erasure or restriction of processing, we will notify third parties also handling the relevant personal information unless this proves impossible or involves disproportionate effort.
    • Right to Lodge Complaint. We commit to resolve complaints about our collection or use of your personal information. You also have the right to lodge a complaint with the supervisory authority of your habitual residence, place of work or place of alleged infringement, if you consider that the processing of your personal information infringes applicable law.

International Transfers In the delivery of the Services, we may need to transfer your personal information outside the Designated Countries, including to countries that do not provide the same level of protection for personal information. In such case, we will only transfer personal information to recipients that provide an adequate level of data protection or as permitted by applicable data-protection laws by implementing appropriate safeguards, including, but not limited to, relevant data-transfer agreements based on the EU Standard Contractual Clauses or UK Standard Contractual Clauses, as applicable (“Clauses”). The Clauses shall apply to any transfers of personal information from the Designated Countries to countries which do not ensure an adequate level of data protection within the meaning of the applicable law.
  5. Legal Bases for Processing Personal Data. Our legal bases for collecting and using the personal information described above will depend on the type of personal information collected, the specific context in which we collect it and the purposes for which it is used. We rely on the following legal bases under the European Union’s General Data Protection Regulation (“GDPR”) (or the equivalent legal bases under the UK GDPR) in processing your personal information. Article 6(1) of the GDPR describes when processing can be done lawfully. When we process your personal information for a specified purpose, we shall apply one of the Article 6 legal bases described below.
    • Whenever we require your consent for the processing of your personal information such processing will be based on Article 6(1) lit. (a) GDPR.
    • If the processing of your personal information is necessary for the performance of a contract between you and Growth Monkey or for taking any pre-contractual steps upon your request, such processing will be based on Article 6(1) lit. (b) GDPR. If this data is not processed, Growth Monkey will not be able to execute the contract with you or provide you with access to the Services.
    • Where the processing is necessary for us to comply with a legal obligation, we will process your information on the basis of Article 6(1) lit. (c) GDPR, for example for complying with obligations under anti-money laundering laws.
    • Where the processing is necessary for the purposes of Growth Monkey’s or another party’s legitimate interests, such processing will be made in accordance with Article 6(1) lit. (f) GDPR, for example to enforce legal claims.
